- Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
II. Sources and Categories of Processed Personal Data
- The controller processes personal data that you have provided to them or personal data that the controller has obtained based on fulfilling your order.
- The controller processes your identification and contact details and data necessary for the performance of the contract.
III. Legal Basis and Purpose of Personal Data Processing
- The legal basis for processing personal data is:
- performance of a contract between you and the controller pursuant to Article 6(1)(b) GDPR,
- the controller's legitimate interest in providing direct marketing (especially for sending commercial communications and newsletters) pursuant to Article 6(1)(f) GDPR,
- your consent to processing for the purposes of providing direct marketing (especially for sending commercial communications and newsletters) pursuant to Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, in the event that no order for goods or services has been placed.
- The purpose of processing personal data is:
- to handle your order and exercise rights and obligations arising from the contractual relationship between you and the controller; when placing an order, personal data is required that is necessary for successful order processing (name and address, contact), provision of personal data is a necessary requirement for the conclusion and performance of the contract, without the provision of personal data it is not possible to conclude the contract or for the controller to fulfil it,
- sending commercial communications and carrying out other marketing activities.
- There is no automatic individual decision-making by the controller within the meaning of Article 22 GDPR. You have given your express consent to such processing.
IV. Data Retention Period
- The controller stores personal data:
- for the period necessary for the exercise of rights and obligations arising from the contractual relationship between you and the controller and asserting claims from these contractual relationships (for a period of 15 years from the termination of the contractual relationship).
- for the period until consent to the processing of personal data for marketing purposes is withdrawn, for a maximum of 15 years if personal data is processed on the basis of consent.
- After the expiration of the personal data retention period, the controller will delete the personal data.
V. Recipients of Personal Data (Controller's Subcontractors)
- Recipients of personal data are persons:
- involved in the delivery of goods / services / realization of payments under the contract,
- involved in ensuring the operation of services,
- providing marketing services.
- The controller does not intend to transfer personal data to a third country (to a country outside the EU) or to an international organization. Recipients of personal data in third countries are providers of mailing services / cloud services.
- We use all personal data obtained from customers exclusively for the internal needs of the company, we protect it against misuse and do not provide it to third parties without prior notice or your consent.
Exceptions are external companies that provide support services for us (e.g., transportation, payment transactions, or e-shop development) and state authorities. We may or must provide your personal data to these companies to the minimum extent necessary for trouble-free order processing or the functioning and improvement of the purchasing process.
These activities include:

- if necessary for the investigation of illegal use of our services or for the needs of legal proceedings, data may be provided to criminal investigation authorities,

- the right to access your personal data under Article 15 GDPR,
- the right to rectification of personal data under Article 16 GDPR, or restriction of processing under Article 18 GDPR.
- the right to erasure of personal data under Article 17 GDPR.
- the right to object to processing under Article 21 GDPR and
- the right to data portability under Article 20 GDPR.
- the right to withdraw consent to processing in writing or electronically to the address or email of the controller specified in Article III of these terms.
- You also have the right to file a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.
VII. Personal Data Security Conditions
- The controller declares that they have taken all appropriate technical and organizational measures to secure personal data.
- The controller has taken technical measures to secure data repositories and repositories of personal data in paper form.
- The controller declares that only persons authorized by them have access to personal data.
